The retired New York State trooper charged with DWI after he struck and killed an elderly man last month could face more serious charges.
Frank Murray was charged with misdemeanor DWI after he drove through the intersection at Genesee Street and Dr. Samuel McCree way and hit Harry Thornton, 90.Thornton died of his injuries.
Murray refused a breathalyzer at the scene but a preliminary test showed his blood alcohol content was .08, or that he was legally intoxicated.
A grand jury will soon decide if Murray should face criminal charges.
"I don't believe that the case warrants further charges in my review of it,” defense attorney Tim Rath said, “However, I don't have access to everything the district attorney's office has at this point."
The grand jury will make its decision by the end of October.
