(Rochester, NY) AP 08/04/04 -- A man charged in a road rage killing took a plea deal and agreed to testify against his co-defendant.
Joseph Mullen, 21, of Rochester pleaded guilty Wednesday to attempted first-degree manslaughter in the February 23 death of Nicole Moore, 22. She was shot during an argument that broke out after a traffic accident.
Mullen agreed to testify against 20-year-old Charles Cobb, 20, whose trial for second-degree murder is scheduled for October. Mullen will receive a prison sentence of five to 12 years.
Mullen said he was driving his van with Cobb in the passenger seat when they came across an accident scene involving Moore's car and another car.
He said Moore started smashing the windows of the other car with a baseball bat, and then Cobb got out of the van and shot her.
